1. PRELIMINARY INFORMATION

 

1.1. Here, we establish the terms that you, the user, must know and agree to use our Platform.

 

We ask that you read carefully and ask all your questions, as you will be entering into a binding contract with JOBECAM.

 

If you do not agree or cannot comply with the provisions of this document, you may not use the Platform.

 

If you agree to the terms, thank you for choosing JOBECAM. Please note that for some situations, we will need your consent.

 

To use the JOBECAM Services, you must (1) have the power to form a binding contract with us and not be barred from doing so under any applicable laws and (2) be a resident of a country where the Service is available.

 

BY USING ANY RESOURCE OFFERED BY JOBECAM, THE USER AUTOMATICALLY AGREE TO THESE TERMS OF USE AND OUR PRIVACY POLICY.

 

1.2. DEFINITIONS: For the purposes of these Terms of Use and Privacy Policy, the following are considered:

 

1.2.1. Platform: software platform (“Platform”) by CAMMILA YOCHABELL DOS SANTOS MEDEIROS ME, micro-company, duly registered with the CNPJ under nº 26.517.659/0001-03.

 

1.2.2. Internet Protocol Address (IP Address): the code assigned to a Network Terminal to allow its identification, defined according to international parameters.

 

1.2.3. Internet: the system consisting of a set of logical protocols, structured on a global scale for public and unrestricted use, with the purpose of enabling data communication between terminals through different networks.

 

1.2.4. Password: set of characters that can consist of letters and/or numbers, with the purpose of verifying the identity of the user to access the Website and/or Application.

 

1.2.5. Websites and/or Applications: JOBECAM websites and applications through which the user accesses the services and content made available by JOBECAM.

 

1.2.6. Terminals (or “Terminal”, when considered individually): computers, notebooks, netbooks, smartphones, tablets, palm tops and any other devices that connect to the Internet.

 

1.2.7. User Persons (“User Person”, when considered individually): all people linked to the Company who will use the Sites and/or Applications, fully capable of carrying out acts of civil life or those absolutely or relatively incapable duly represented or assisted.

 

1.2.8 Company: legal entity contracting services provided by JOBECAM that seeks to hire a candidate.

 

1.2.9 JOBECAM Services: as described in the section “WHAT IS JOBECAM?”

 

2. WHAT IS JOBECAM?

2.1. JOBECAM is an online recruitment and selection platform designed to automate talent selection through video technology and artificial intelligence. We want to connect Companies to candidates through a disruptive and efficient way in order to optimize the selection processes for hiring professionals, making them more agile, cheap and fair.

 

ATTENTION: JOBECAM DOES NOT GUARANTEE, UNDER ANY CIRCUMSTANCES, PROMISES OF EMPLOYMENT OR PRESENT OR FUTURE OBLIGATION TO REPLACE OR OBTAIN JOBS FOR THE USER AND DOES NOT MAKE ANY CHARGES RELATED TO THESE ACTIVITIES.

 

2.2. JOBECAM works as follows: we provide users with the possibility of creating a professional profile, a means of demonstrating their skills, history and professional intention.

 

2.2.1. In their profile, the user will have the following ways to demonstrate their skills, namely: CV and video CV. The user can hide their video or not.

 

2.2.2. The user will be able to demonstrate interest in vacancies published in the JOBECAM feed and make their CV, video CV or participate in recorded interviews available, in addition to other information they wish or that the Company requests, such as recording a video interview. In this case, the candidate will read customized questions and answer them, within the time limit set by the recruiter.

 

2.3. The Company may advertise vacancies and receive applications through JOBECAM. The Company may also contact candidates in the form of an active search.

 

2.3.1. If the Company is interested, the user can participate in a profile analysis through an anonymous video interview, as we believe that this method reduces the unconscious biases of recruiters when analyzing candidates, focusing only on their skills and experiences.

 

2.3.2. The candidate will be aware that, when recording the video interview with the questions given by the company, they will not have access to this material. Unless the company wants to make the video available, this is at its discretion and JOBECAM has no responsibility for this. The recording will be done in real time.

 

2.3.3. The selection process conducted by JOBECAM may be carried out anonymously or pseudo-anonymously, according to the following conditions:

 

(i)           Anonymity: In certain cases, the selection process will be conducted 100% anonymously for the managers involved in the recruitment. In these cases, the personal information of candidates will be kept confidential and will not be disclosed to the management people responsible for making the decision.

(ii)          Pseudo-anonymity: In other cases, the selection process will be conducted pseudo-anonymously, which means that the recruitment team will have access to the candidates' personal information, while the conventional management team involved in the recruitment will only have access to information relevant to the process. selection process, without having direct knowledge of the identity of the candidates.

 

2.3.3.1. The decision to carry out the selection process anonymously or pseudo-anonymously will be based on the company's internal criteria, aiming to guarantee impartiality and equalization of opportunities for all candidates.

 

2.3.3.2. JOBECAM undertakes to adopt appropriate measures to protect the privacy and confidentiality of candidates, regardless of the method used in the selection process, in accordance with applicable laws and regulations regarding the protection of personal data.

 

2.3.3.3. By participating in the selection process, candidates agree to the anonymous or pseudo-anonymous use of their information, as described in this clause, for the exclusive purposes of evaluating and selecting talent.

 

2.3.3.4. JOBECAM informs that, when dealing with selection processes for people with disabilities, in particular for deaf people, the anonymous interview mode will not be used. This decision is based on the impossibility of communicating in Libras (Brazilian Sign Language) due to the presence of avatars on the screen.

 

2.3.3.4.1. Notice to Companies: The Company must commit to providing clear and precise guidance on selection processes for people with disabilities, including deaf people. The Company must explain the reason for not being able to carry out the anonymous interview mode, as well as indicate that accessibility measures will be adopted to facilitate the conventional interview process, using the Handtalks plugin, which offers translation resources into Libras.

 

2.3.3.4.2. Notice to candidates: It is important that deaf candidates are aware that the selection process for deaf people will not be conducted anonymously. This occurs due to the impossibility of communicating in Libras through the avatars present on the platform. However, JOBECAM is committed to providing accessibility and ensuring that the selection process is conducted in an inclusive and fair manner, through the use of the Handtalks plugin for Libras translation.

 

2.3.3.5. Any personal information collected during the selection process will be treated securely and in accordance with JOBECAM's Privacy Policy.

 

2.3.3.6. JOBECAM reserves the right to change the anonymity or pseudo-anonymity approach in the selection process, as long as it is done in accordance with applicable legislation and recommended personal data protection practices.

 

2.3.3.7. Candidates who wish to obtain more information about the use of their personal data in the selection process can contact the JOBECAM recruitment team through the communication channels provided.

 

2.4. To present candidates to companies, JOBECAM uses its own ranking system, which is based on an intelligent keyword matching system. The objective is to compare the information provided by recruiters during job registration with the answers given by candidates during the interview.

 

2.4.1. The ranking process occurs as follows: the interview is transcribed and the information is compared with the criteria established by the recruiting person in the vacancy registration. A "match" is made between the requested keywords and the answers provided by the candidates.

 

2.4.2. It is important to highlight that the ranking aims to classify the profiles of candidates according to their suitability for the vacancy requirements. This is not about eliminating or rejecting any talent in the selection process. JOBECAM WILL AT NO TIME ELIMINATE OR REJECT A CANDIDATE.

 

2.4.3. JOBECAM emphasizes that the objective of the ranking is to facilitate the identification of candidates who are most aligned with the criteria established for the vacancy. This classification should not be interpreted as a disapproval of other candidates, but rather as an auxiliary tool for the selection process.

 

2.4.4. The ranking system is based on algorithms and criteria defined by JOBECAM and the Company. All candidates are evaluated with impartiality and respect, regardless of their position in the ranking.

 

2.4. This is the summary of the JOBECAM Service.

 

2.4.1. JOBECAM does not participate in any negotiations, dealings between the user and the Company, and cannot, therefore, be held responsible for losses and damages of any kind that may become known as a result of such negotiations, and is also not responsible for carrying out the hiring the candidate.

 

2.4.2. JOBECAM may, at its sole discretion, delete, modify or block the transmission of information that violates the obligations set out in these Terms of Use and the Privacy Policy.

 

3. REGISTRATION

3.1. The user may use the Platform by registering personal information to open their account.

 

3.2. To access the Platform, the user must register by accessing their social network profile or providing registration information. JOBECAM will require information for the account to be valid, so the user will indicate their name, email, telephone number, login name and password, address, civil identification numbers, date of birth, photo, channel data input, gender. Depending on your State, you will need to provide self-declaration about your color/race.

 

3.2.1. The user can provide, if desired, additional information during the registration flow (location, telephone number, education, position, color, race, gender and if they have any disability) in order to provide the user with more personalized services such as a profile page best suited to your language (presentations in multilingual format), career opportunities, among others. FROM NOW The user agrees that JOBECAM can store and process information, as well as share this information with third parties to fulfill its services, as provided in these Terms of Use, even if this information is considered sensitive by Brazilian Law No. 13,709, OF 14 DE AUGUST 2018 (“LGPD”).

 

3.2.2. In the event that sensitive personal data (ie, data on racial or ethnic origin, religious beliefs, political opinions, health, sexual life, genetic and biometric data) are collected, Jobecam undertakes to first obtain the person's consent user in strict accordance with the provisions of the LGPD.

 

3.3. If there is false, incorrect, outdated or incomplete information in the user's registration, JOBECAM is not responsible for the correction of this data entered by its users. JOBECAM also reserves the right to request additional data and documents that it deems pertinent, in order to check the data provided by the user, as well as disqualify, temporarily or definitively, the user who presents any information that is not true, and may, also, do so in relation to users whose JOBECAM cannot contact to verify the data. When the user's registration is canceled, their access to the use of this platform and any service related to it will automatically be cancelled, and the user, for this reason, will not be entitled to any type of compensation or reimbursement.

 

4. INTELLECTUAL PROPERTY, TERMS OF USE OF IMAGE AND VOICE

4.1. The user may not infringe the rights of third parties, especially copyrights, such as reproducing, modifying or publishing another's work without the prior authorization of the owner.

 

4.2. JOBECAM will provide users with public and private spaces to disseminate their presentation video, and JOBECAM is not responsible for what is disclosed, whether this content is in written, image, recorded or spoken form. The video interviews will be directed to the requesting companies, which may, recruiters, headhunters or third parties, share this content on other networks. JOBECAM may use this material as an internal database and may eventually be shared with partners nationally or internationally.

 

4.3. Regarding the public part, by accepting this term of use, the user authorizes public access to the materials inserted on the platform, be they: photos, data, video resume, video interview, voice audio and image captured in the recordings.

 

4.4. Alerting the user that, although they choose the private way of publishing their video presentation on their JOBECAM account, the user will have their public profile just like in any other communication media, since the data is public for viewing and disclosure by the user, thus being aware that their CV and other information entered on the website may be viewed by third parties. In this way, JOBECAM is exempt from any damages suffered as a result of this exposure, and cannot be held responsible.

 

4.5. Once the video interview has been carried out, only the company to which the user applied will have access to this material, and they can share the content with anyone they deem relevant for evaluating the candidate. JOBECAM is not responsible for the content recorded and used in these interviews, with the user (candidate) being fully responsible for any and all actions and speeches included in the video. The candidate will not have access to this material, unless the Company wants to share it with them, which is also not the company's obligation to do so. The recording will be done in real time, the material cannot be re-recorded or edited.

 

4.6. The recorded videos, whether presentation or interview recorded on the user's profile, are their sole responsibility, and JOBECAM is not responsible for any type of sharing, whether due or improper, made by the user or third parties. Every photo and/or video available on the platform may be accessed by third parties.

 

4.7. JOBECAM may use video resumes (presentations), recorded interviews, and video audio for professional assessments, cultural fit, and behavioral evaluations exclusively for analyzing the candidate's application.

 

4.7.1. JOBECAM may change the audio, image and hide data of the people evaluated in the anonymous methodology processes.

 

4.8. All opinions expressed in the comments on this site do not express the opinion of JOBECAM, but only the opinion of the person who wrote them.

 

4.9. Subject to the provisions of these Terms of Use, JOBECAM grants the user a non-exclusive, revocable, temporary and non-transferable license to use the Platform.

 

4.9.1. The form and content of the Platform are the exclusive responsibility and property of JOBECAM, with the exception of data and content disclosed on the Platform by the users themselves, which in this case are their sole and exclusive responsibility.

 

4.9.2. All JOBECAM trademarks, service marks, trade names, logos, domain names, and any other features of the JOBECAM brand are the exclusive property of JOBECAM or its licensors. The user does not have any right to use any JOBECAM intellectual property, whether for commercial or non-commercial use.

 

5. OBLIGATIONS AND DECLARATIONS OF USERS

5.1. We request that any registration data provided to the Platform is true, current and complete. If information is changed or updated, the user can make these changes directly on the platform or, if necessary, inform them through our customer service channel: contato@jobecam.com.

 

5.2. During registration, you will need to define your account access login and password. The user is responsible for maintaining the confidentiality of this information and for all activities and posts made using the account. Please notify JOBECAM immediately if you suspect that an unauthorized person has accessed the account.

 

5.3. You agree to use the Platform only in accordance with the terms established in these Terms of Use, avoiding any conflict with applicable legislation. By way of example, and not limitation, you agree NOT to:

 

(i) post content or items in inappropriate categories or areas on our websites and services;

(ii) violate laws, the rights of third parties or our internal policies;

(iii) post false, inaccurate, misleading, defamatory or offensive content against the JOBECAM Platform or any user;

(iv) distribute or post unsolicited spam, mass electronic communications, chain letters or pyramid schemes;

(v) distribute viruses or any other technologies that may harm the Platform;

(vi) attempt to modify, translate, adapt, decompile, disassemble or reverse engineer any software program used in connection with the Platform;

(vii) copy, modify or distribute the rights or content of the Platform or the company's copyrights and trademarks; It is

(viii) collect or collect any information about users without their consent.

 

5.4. JOBECAM reserves the right to exclude users from the Platform if they fail to comply with any of the terms agreed in these Terms of Use.

 

5.4.1. Upon receiving a report regarding violation of the conditions established in this term, especially in the case of illicit practices, JOBECAM will disable the user, within 24 (twenty-four) hours, as well as make the content transmitted by them unavailable, without this is entitled to any type of compensation or reimbursement.

 

5.4.2. JOBECAM reserves the right to exclude any resume and/or video resume that presents information that is not true, data discrepancies or that does not comply with our policies.

 

5.5. The content produced by the user will not be modified by JOBECAM, but may be used for statistical analysis, research and/or database maintenance, and may be sold or shared with partners, as described in the attached Privacy Policy.

 

6. OBLIGATIONS AND DECLARATIONS OF JOBECAM

6.1. Provide login (access) to users after electronic acceptance of these Terms of Use.

 

6.2. Guarantee user access to the Platform in accordance with the terms agreed here, allowing access to all tools made available to users after login.

 

6.3. JOBECAM will use reasonable efforts to keep the JOBECAM Services running. However, some technical difficulties or maintenance may result in temporary interruptions. To the extent permitted by applicable law, JOBECAM reserves the right, periodically and at any time, to modify or discontinue, temporarily or permanently, functions and features of the JOBECAM Services, with or without notice, without any charge, except where prohibited. by law, in connection with any interruption, modification or discontinuance of the JOBECAM Services or any function or feature thereof.

 

6.4. The user understands, agrees and accepts that JOBECAM has no obligation to maintain, provide support, update or update the Services, nor to provide any specific content through the Services. This section will apply to the fullest extent permitted by applicable law. JOBECAM and/or the owners of any content may, from time to time, remove such content without prior notice, to the extent permitted by applicable law.

 

6.5. JOBECAM guarantees that during the term of use of the Platform by users, it will operate regularly on a reasonable basis, except in unforeseeable cases and proven force majeure.

 

6.6. The warranty provided for in these Terms and Conditions of Use will be excluded in the following cases:

 

·                     Defect arising from misuse of the Platform by the user, such as failure to comply with the procedures established by JOBECAM;

·                     Finding that the Platform system has been used or violated by unauthorized third parties, as well as problems arising from procedures not indicated in the technical manuals, such as hacking;

·                     Problems arising from telephone service companies that provide signals for internet access, being considered fortuitous cases and force majeure;

·                     Equipment malfunction caused by downtime or unavailability of the server where the Platform is hosted.

 

7. RESPONSIBILITIES

7.1. JOBECAM Services are connected to third-party applications, websites and services ("Third-Party Applications") to provide content, products and/or services to users. These Third Party Applications have their own terms of use and privacy policies, and your use of them is governed by those terms and policies. Please understand that JOBECAM neither endorses nor is responsible for the behavior, features or content of any Third-Party Applications, nor for transactions entered into with the provider of such Third-Party Applications.

 

7.2. We agree that if you have any problems or dissatisfaction with the JOBECAM Services, your sole remedy is to uninstall any JOBECAM software and stop using the Services.

 

7.3. Under no circumstances will JOBECAM, its officers, shareholders, employees, agents, directors, subsidiaries, affiliates, successors, assigns, suppliers or licensors be responsible for:

(1) indirect, special, incidental, punitive, exemplary or consequential damages;

(2) loss of use, data, business or profits (whether direct or indirect) arising from the use of or inability to use the JOBECAM Services, the third-party applications or the content of those applications, regardless of legal theory, even if JOBECAM has been informed about the possibility of these damages and even if a solution does not achieve its essential purpose; or

(3) full liability for all claims relating to JOBECAM services, third-party applications or content of third-party applications that exceed the amounts paid by users to JOBECAM in the last twelve months, to the maximum extent permitted by applicable law.

 

8. NOTIFICATIONS

8.1. All notifications from JOBECAM users must be made through the contact channel with the platform administration team. All notifications and communications from JOBECAM to users will be considered valid and effective when made by:

 

(i) email to any email address provided by users;

(ii) letter to the address provided by users of the platform;

(iii) SMS or message via Whatsapp; or

(iv) messages posted on the platform and in places where users usually access them.

 

8.2. Users declare that all data provided is valid, updated and correct, and undertake to communicate and update the platform about any changes to their personal data.

 

9. ACCOUNT DELETION

9.1. Users may choose to delete their JOBECAM accounts and stop using the JOBECAM Service. To do this, simply access the website and click on the "Cancel Profile" link and, optionally, respond to a quality survey.

 

10. OTHER PROVISIONS

10.1. Any questions or requests related to these Terms of Use or the platform's Privacy Policy must be sent to JOBECAM by email at contato@jobecam.com.

 

10.2. If any part of these Terms is found to be invalid, it will be removed and the remaining terms will remain in effect.

 

11. APPLICABLE LAW / JURISDICTION

11.1. Unless required by a mandatory law of a member state of the European Union or any other jurisdiction, these JOBECAM Terms of Use and Privacy Policy (and any non-contractual disputes/claims arising out of or in connection with them) are governed by the laws of the state or country listed below, without regard to choice or conflict of law principles.

 

11.2. Unless required by a mandatory law of a member state of the European Union or any other jurisdiction, these JOBECAM Terms of Use and Privacy Policy (and any non-contractual disputes/claims arising out of or in connection with them) are subject to the laws of the Federative Republic of Brazil, regardless of the country in which the website is accessed. Any disputes or legal controversies arising from actions taken on this website by users , including non-compliance with the Terms of Use and Privacy Policy or violation of third party rights, will be processed in the District of São Paulo, State of São Paulo.

 

11.3. CLASS ACTION WAIVER

 

IF PERMITTED BY APPLICABLE LAW, THE PARTIES AGREE THAT EACH MAY BRING CLAIMS AGAINST EACH OTHER ONLY INDIVIDUALLY AND NOT AS A PLAINTIFF OR MEMBER OF A GROUP IN ANY CLASS OR REPRESENTATIVE ACTION. Unless you and JOBECAM agree, no judge may consolidate more than one person's claims or preside over any form of a representative or class proceeding.

 

PRIVACY POLICY AND DISCLOSURE OF INFORMATION

1.1. We may collect the following information from you, candidate, to enable the operation of JOBECAM, which is a professional recruitment and selection platform:

 

i. Registration Data: we collect information to create and update your registration. This may include your social network login information, name, email, phone number, username and password, address, identification numbers, date of birth, photo, input channel information, gender, color, race , if you have a disability, etc. You may also provide additional personal information to personalize your experience on the Platform. By agreeing to this, we understand that we can store and use this information, even if it is considered sensitive by law, in addition to sharing it with third parties to improve our services and improve the Platform.

 

ii. Demographic Information: We collect demographic information about you, the applicant, through user surveys.

 

iii. User Person Content: we collect the information you send us when contacting JOBECAM support, in addition to the information contained in your video resume, recordings of anonymous interviews and other possible materials.

 

iv. Location: Depending on your smartphone's settings or permissions, we may collect your exact or approximate location through data such as GPS, IP address and Wi-Fi.

 

v. Usage Information: We collect information about how you interact with our Services. This includes, for example, date and time of access, application features or pages visited, application crashes and other system activity, browser type, and third-party websites you visited before using our services. In some cases, we use cookies, pixels and similar technologies to create and maintain unique identifiers.
